Case 11-393, National Federation of Independent Business vs. Kathleen Sebelius, Secretary of Health and Human Services, it is argued that HR 3962 violates the US Constitution, Article I, Section 8, Clause 3:[2], (Commerce Clause):

The US Constitution, Article I, Section 8, Clause 3:[2], (Commerce Clause) grants Congress the authority to regulate HR 3962 since HR 3962 was passed by Congress.
