The Affordable Health Care Act (HR 3962) was passed by the US Congress that has the constitutional authority to levy taxes, based on USC section 7421(a):

US Supreme Court Case No. 11-398, Dept of Health and Human Services vs. State of Forida, based on USC sec 7421(a), is invalid since Congress passed HR 3962 and the Article 1, Section 8, Clause 3, (Commerce Clause) allows
Congress to regulate Commerce.
