In the Supreme Court Case, Moore vs. Obama. It is argued that the affordable care act violates US constitution, Article I, Section 8, Clause 3:[2], commerce clause.

[The Congress shall have Power] To regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes;

If the US Supreme Court rules against HR 3962 then the federal government would no long have the authority to impose federal income taxes that are used to regulated commerce within the US since Health care represents Commerce.
